Welcome to Crypto Mart, LLC (“Crypto Mart”, “we”, “us”, “our”). We extend a warm welcome to all visitors (“you”, “your”, “customer”) to our online platform and/or Bitcoin ATM services (collectively referred to as the “Service”). By using our Service, you agree to abide by the following terms and disclaimers, regardless of whether you are a registered Crypto Mart customer. Sending funds to a wallet you do not control is a direct violation of our terms and will result in a ban from our platform.

Account Creation and Usage

In order to access certain Crypto Mart offerings, you must create an account with us (“Account”). By creating an Account, you commit to the following:

  1. Providing accurate, truthful, and up-to-date registration data during Account creation and when using our Kiosks.
  2. Using your Account and Crypto Mart offerings solely for your personal use, refraining from sharing access or conducting transactions on behalf of others.
  3. Promptly notifying us of any security breaches or misuse linked to your Account.
  4. Solely sending funds to your personal wallet and not to the wallet of any third-party individual or entity.

Account Status

Your account with us is not a bank account. Our services are not financial instruments, and we are not a regulated financial institution. We are, however, a regulated money service business. No interest will be paid on any funds or currency you use to purchase or trade for any other currency, and such currency is not insured by the company or any government agency.

Risks of Trading Virtual Currency

Trading goods, including digital currencies, involves significant risk due to price fluctuations. You may experience gains or losses in asset value at any given moment. Any currency, digital or otherwise, can undergo drastic value swings, even becoming worthless. There is an inherent risk that losses will occur as a result of buying, selling, or trading anything on a market. Digital currency trading also has special risks not generally shared with fiat currencies or goods or commodities in a market. Unlike fiat currencies, which are backed by governments or other legal entities, or by commodities such as gold or silver, digital currency is backed by technology and its perceived value in the marketplace. Cryptocurrency investments are risky, and past performance does not guarantee future results.

In no event shall Crypto Mart or its affiliates be held liable for any investment gains or losses you incur related to your use of our Service. This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action.

Fraud Prevention

Within the cryptocurrency landscape, scams pose significant risks. If you’re uncertain about a situation and suspect it might be a scam, please reach out to us. To enhance your protection against fraud, we offer the following guidelines:

  • Unsolicited Requests for Payment: Be wary of individuals or companies reaching out to you unexpectedly, asking for cryptocurrency payments. Scammers often pose as service providers, authorities, or friends in need. If someone is legitimate, they should be able to receive funds by wire transfer or other means.
  • Too Good to Be True Offers: If an offer or “investment program” promises extremely high returns or seems too good to be true, it’s likely a scam. Scammers often entice victims with unrealistic profit opportunities.
  • Pressure to Act Quickly: Scammers often create a sense of urgency to pressure victims into making hasty decisions. Take your time and thoroughly research any investment or transaction. Never send cryptocurrency to someone that you do not personally know and trust.
  • Government Impostors: Scammers might impersonate government agencies or law enforcement, claiming you owe taxes or fines in cryptocurrency. Always verify the legitimacy of such claims through official channels.
  • Money Mule Scams: Be cautious if someone asks you to receive cryptocurrency on their behalf or to facilitate transactions for them. You might unknowingly become involved in illegal activities.
  • Romance Scams: Avoid sending cryptocurrency to individuals you’ve met online who request funds for various reasons, often exploiting emotions and trust to steal money.

Warranty Disclaimer

You acknowledge that using our Service is at your own risk. Crypto Mart makes no guarantees that its offerings or materials are uninterrupted, timely, secure, or error-free. Furthermore, Crypto Mart makes no warranty regarding any transactions conducted through our Service. You understand and agree that the value of virtual currencies can be volatile and Crypto Mart is not in any way responsible or liable for any losses you may incur by holding or trading virtual currencies, even if our Service is delayed, suspended, or interrupted for any reason. The warranties and representations set forth in this agreement are the only warranties and representations made by us with respect to this agreement and our Service is in lieu of any and all other warranties, written or oral, expressed or implied, that may arise either by agreement between the parties or by operation of law or otherwise, including warranties of merchantability and fitness for a particular purpose which are excluded to the fullest extent permitted by applicable laws. None of these warranties and representations will extend to any third person.

Restricted Activities

When using Crypto Mart’s Service, you must adhere to the following rules:

  • Abide by all applicable international, federal, state, and local laws.
  • Comply with regulations concerning money laundering, licensing, and financial services.
  • Do not breach the Terms of Service or any other agreement or policy you have entered into with us.
  • Refrain from violating laws related to financial services, consumer protections, unfair competition, anti-discrimination, or false advertising.
  • Avoid infringing upon intellectual property rights, including copyright, patent, trademark, or trade secret.
  • Do not use counterfeit currency.
  • Provide accurate and honest information.
  • Act responsibly and avoid defamatory, threatening, or abusive behavior.
  • Do not engage in scams or fraudulent transactions or send potentially fraudulent funds.
  • Do not send funds to a wallet you do not control.
  • Use your Account solely for personal purposes; do not share access.
  • Do not control linked Accounts engaged in prohibited activities.
  • Cooperate in investigations and confirm your identity when requested.
  • Do not damage, modify, or interfere with Crypto Mart’s platforms, hardware, or software.
  • Avoid bypassing or disabling Crypto Mart offerings or verification procedures.
  • Do not attempt to use another user’s Account, wallet, or repository without explicit permission.
  • Do not use Crypto Mart offerings for illegal activities, including illegal gambling, fraudulent content, money laundering, terrorist financing, or human trafficking.

If we have reason to believe you’ve engaged in restricted activities, we reserve the right to take appropriate actions, including closing your account or limiting access. Should we decide to close your Account or discontinue your use of our Service for any reason, we might furnish you with a general notification of our actions; however, we are not obligated to provide the specific rationale. In the event of access limitations on your Account, we will notify you of our actions and grant you the chance to request access restoration if deemed appropriate.
